1. Overview

VINDAFARNA (vindafarna.com) is operated by Bahersam LLC. In these terms, "we", "us" and "our" mean Bahersam LLC.

These terms are a binding agreement between you and Bahersam LLC. By visiting our site or placing an order, you agree to these Terms of service and to our Privacy policy, Shipping policy and Return policy, which are part of these terms. If you do not agree, do not use the site.

2. Who can order

You must be at least 18 years old, or the age of majority where you live, to place an order. If you are younger, you may use the site only with the permission of a parent or legal guardian.

Our products are sold for personal use only. We may refuse or cancel any order that appears to be placed by a reseller, dealer or distributor.

3. Products and prices

All prices are shown in US dollars (USD). We do our best to show our products, colors and sizes accurately, but colors and details may look different on your screen. Small differences in color, size, measurements or finish are normal and are not defects.

We may change prices, update product descriptions, limit quantities or stop offering a product at any time without notice. The site may contain errors in prices, descriptions, promotions or availability. We may correct any error at any time and cancel any order affected by it, including after the order has been confirmed or paid.

4. Orders

Your order is an offer to buy. The order confirmation email only shows that we received your order. We accept an order only when we ship it.

We may refuse, limit or cancel any order at our sole discretion, for example if an item is out of stock, if there is a pricing or listing error, if the order exceeds quantity limits, or if we suspect fraud, abuse or unauthorized payment. If we cancel an order you have already paid for, our only obligation is to refund the amount you paid to your original payment method.

You are responsible for giving current, complete and accurate information for every order, including your email and shipping address.

5. Payment, sales tax and chargebacks

Payments are processed at checkout by third-party payment providers. By placing an order, you confirm that you are authorized to use the payment method and you authorize us to charge the full order amount, including shipping and sales tax. Sales tax is collected where required.

If you have a problem with an order, you agree to contact us first at support@vindafarna.com so we can resolve it. If a chargeback or payment dispute is filed for a valid order, we may contest it and share order, delivery and communication records with the payment provider. We may refuse future orders from anyone who files a chargeback without a valid reason.

6. Promotions and store credit

Discount codes and promotions have no cash value, cannot be applied to past orders, and cannot be combined unless we say so. We may change, limit or end any promotion at any time, and cancel orders where a code was used in a way we did not intend.

Store credit can be used only on vindafarna.com. It has no cash value, cannot be transferred or resold, and cannot be exchanged for cash except where required by law.

7. Shipping and delivery

We ship within the United States only. Orders ship from New York, normally within 2 business days. Details are in our Shipping policy.

Delivery dates are estimates and are not guaranteed. Ownership and risk of loss pass to you when we hand your order to the carrier. We are not responsible for carrier delays, or for packages that the carrier confirms as delivered to the address you gave us.

You are responsible for the shipping address you enter. If an order comes back to us because the address was wrong or incomplete, or because delivery was refused or not picked up, we may charge a new shipping fee to send it again, and the original shipping charge is not refunded.

8. Returns and refunds

You can return eligible items within 14 days of delivery. Items must be unworn, unwashed and undamaged, with the original tags attached. Items in bundles (3-pack or 5-pack) and items marked Final sale cannot be returned or refunded. You pay return shipping, and original shipping charges are not refunded.

Full conditions and steps are in our Return policy. We may refuse any return that does not meet those conditions. The remedies in the Return policy are your only remedies for a product you are not satisfied with.

9. Using our site

You agree not to use the site for any unlawful purpose, interfere with its security or operation, upload viruses or harmful code, use bots, scrapers or other automated tools, collect other people's personal information, or submit false or misleading information.

We may suspend or end your access, and cancel any open orders, at any time and without notice if we believe you have broken these terms.

10. Reviews and content you send us

If you send or post reviews, photos, comments or other content, or tag us on social media, you give Bahersam LLC a non-exclusive, royalty-free, perpetual, worldwide right to use, reproduce, edit, publish and display that content in any media, including for marketing, without payment to you. You confirm that you have the right to share that content. We may remove any content at any time.

11. Intellectual property

The VINDAFARNA name, logo, product designs, photos, text and all other content on this site belong to Bahersam LLC or its licensors and are protected by law. You may not copy, reproduce, modify, resell or use any of it for commercial purposes without our prior written permission.

12. Third-party links and services

Our site may include links to, or tools provided by, third parties such as payment providers and shipping carriers. We are not responsible for their websites, content, products or services, and their own terms and policies apply.

13. Disclaimer of warranties

EXCEPT AS EXPRESSLY STATED IN OUR RETURN POLICY, AND TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE AVAILABLE, UNINTERRUPTED, SECURE OR FREE OF ERRORS.

14. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BAHERSAM LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS AND SUPPLIERS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, OR FOR ANY LOST PROFITS, REVENUE OR DATA, ARISING FROM OR RELATED TO THE SITE, OUR PRODUCTS OR THESE TERMS, EVEN IF WE WERE TOLD THAT SUCH DAMAGES WERE POSSIBLE.

OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID FOR THE ORDER THAT THE CLAIM IS ABOUT.

Some states do not allow certain limits, so parts of sections 13 and 14 may not apply to you. In that case they apply to the fullest extent the law allows.

15. Indemnification

You agree to defend, indemnify and hold harmless Bahersam LLC and its members, managers, employees, contractors and suppliers from any claim, loss, damage, liability, cost or expense, including reasonable attorneys' fees, arising from your use of the site or our products, your breach of these terms, or your violation of any law or the rights of others.

16. Governing law and disputes

These terms and any dispute related to the site, our products or your order are governed by the laws of the State of New York, United States, without regard to its conflict of law rules.

Before starting any legal action, you agree to email us at support@vindafarna.com with a description of the problem and give us 30 days to resolve it.

Any dispute that is not resolved this way must be brought only in the state courts located in Queens County, New York, or the federal courts for the Eastern District of New York, and you agree to the jurisdiction of those courts.

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND BAHERSAM LLC EACH WAIVE THE RIGHT TO A JURY TRIAL, AND YOU AGREE TO BRING CLAIMS ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR MEMBER OF ANY CLASS, COLLECTIVE OR REPRESENTATIVE ACTION.

Any claim must be filed within one (1) year after it arises. After that, the claim is permanently barred.

17. Events beyond our control

We are not responsible for any delay or failure to perform caused by events beyond our reasonable control, including severe weather, natural disasters, carrier or supplier delays, labor disputes, internet or payment system outages, government actions or public health emergencies.

18. Changes to these terms

We may update these terms at any time by posting the new version on this page. Changes take effect when posted. By using the site or placing an order after a change, you accept the updated terms. The terms in effect when you place an order apply to that order.

19. General

These terms, together with the policies linked above, are the entire agreement between you and Bahersam LLC about the site and your orders. If any part of these terms is found to be unenforceable, that part will be limited as little as necessary and the rest remains in effect. If we do not enforce a right, that does not mean we have given it up. We may assign these terms to another party. You may not assign them without our written consent. You agree that we may send you notices about your orders and these terms by email.
